Terms of Service

These terms explain the rules for Tithe and its online services.

1. Who we are and what these terms cover

These Terms of Service are an agreement between you and Bitspire Studio. In these terms, “Bitspire”, “we”, “us”, and “our” mean Bitspire Studio.

These terms apply to these services:

  • Tithe, including test, preview, early-access, and release versions of the game;
  • the Tithe pages at bitspire.studio, including account and playtest-access functions;
  • Tithe multiplayer, voice chat, text chat, lobbies, achievements, and related online functions; and
  • the Tithe Discord application and integration, including Rich Presence, invitations, and join functions.

In these terms, “Game” means Tithe. “Site” means the Tithe pages at bitspire.studio. “Discord Integration” means the Tithe functions for Discord. “Services” means the Game, Site, online functions, and Discord Integration together.

The Privacy Policy explains how we handle personal data. Read it with these terms.

2. Accepting these terms

You accept these terms when you download, install, access, or use a Service. Do not use the Services if you do not accept these terms.

If you use the Services for an organisation, you confirm that you can accept these terms for that organisation.

Third-party platforms can also apply their terms and policies. Examples are Steam and Discord. Their terms govern your relationship with them. These terms govern your relationship with Bitspire.

3. Age and eligibility

You must be at least 13 years old. A higher minimum age can apply in your country or on a platform that you use. If you are not a legal adult, get permission from a parent or legal guardian. Ask that person to read these terms with you.

The Game has dark-fantasy and horror themes. It can contain fantasy violence, death, frightening creatures, and online contact with other players. Follow all age ratings, parental controls, and local restrictions that apply to you.

Do not use the Services if the law does not permit you to use them.

4. Licence to use Tithe

Bitspire gives you a limited licence to install and use the Game and related Bitspire content. This licence is personal, non-exclusive, non-transferable, and revocable. You can use the content only for non-commercial entertainment and testing. These terms and platform terms apply to the licence.

Bitspire licenses the Game to you. Bitspire does not sell the Game to you. Bitspire and its licensors keep all rights that these terms do not give to you.

Unless the law permits an action, do not:

  • copy, distribute, sell, rent, lease, sublicense, or commercially exploit a Service;
  • reverse engineer, decompile, disassemble, or try to get source code from a Service;
  • modify a Service or make a derivative work;
  • bypass a technical restriction, access control, playtest gate, security measure, or platform protection;
  • use unauthorised software, bots, scripts, trainers, injected code, or automation with a Service;
  • host, emulate, redirect, or interfere with Service communications, unless Bitspire provides a function for that purpose; or
  • remove a copyright, trademark, attribution, or ownership notice.

This section does not restrict a right that the law does not permit us to restrict. This can include mandatory rights for interoperability or reverse engineering.

5. Accounts, Steam, and playtest access

The Game can use your Steam account for authentication, lobbies, network relay, achievements, playtest access, distribution, and related functions. The Site can use Steam sign-in to confirm your Steam identity. It can also check if your account can access a private build.

Keep your Steam, Discord, device, and other account credentials secure. Do not give your Steam or Discord password to Bitspire. Bitspire is not responsible for a loss that results when you do not secure an account, unless the law says otherwise.

Playtest access is personal, limited, and revocable. Bitspire can restrict it to approved Steam accounts. Do not share a session token, private download link, access credential, or build with a person that Bitspire did not approve.

6. Multiplayer and network functions

Tithe uses peer-hosted multiplayer. A player can host a direct local network session or a Steam lobby. Steam networking and relay services can support a Steam lobby. The host device controls the session. It sends some game, text-chat, and voice-chat data to other players.

When you join a session, the host and other players can receive data that the session needs. This data can include:

  • your player name, random user identifier, and Steam identifier;
  • your portrait and character settings;
  • your position, status, actions, inventory, and match statistics;
  • your text messages, voice packets, and speaking status; and
  • network data, such as an IP address, during a direct connection.

Players operate multiplayer sessions. Bitspire does not continuously supervise them. A host can change lobby settings, remove a player, end a session, or control access. Bitspire cannot promise good conduct, availability, connection quality, or security in a player-hosted session.

7. Voice chat, text chat, and player content

Tithe has proximity voice chat and text chat. Voice chat can use an open microphone or an activation mode that you select. Check your microphone settings before you join a session. You can mute your microphone. You can also mute another player on your device.

The host and other players can receive content that you send in multiplayer. This content can include speech, text, names, drawings, and uploads. Do not send information that you want to keep private. Other players can use external tools to record audio, video, screenshots, or messages. Bitspire does not control these recordings. Follow all consent and recording laws. Do not record or misuse another person’s communications unlawfully.

“Player Content” means content that you provide through the Services. It includes player names, lobby names, chat messages, character markings, and portraits. You keep your rights in your Player Content.

You give Bitspire a limited, worldwide, royalty-free licence to process your Player Content. You also give this licence to the session host and players when it is technically necessary. They can host, copy, encode, send, display, and process the content only to operate, secure, and provide the Services.

This licence ends when the relevant content is deleted or the session ends. It does not end for a copy that another user made lawfully. It also does not end for data that the law requires a person to keep.

You confirm that you have all rights and permissions that you need for your Player Content. Your Player Content must not break these terms or another person’s rights.

8. Acceptable use and player conduct

Do not use the Services to:

  • harass, threaten, stalk, bully, shame, or impersonate a person;
  • promote hate or discrimination against a protected group;
  • send sexually explicit content or any sexual content that involves a minor;
  • share personal or confidential information about another person without permission;
  • violate copyright, trademark, privacy, publicity, or another right;
  • distribute malware, malicious links, scams, or deceptive content;
  • exploit bugs, duplicate items, manipulate achievements, change saves for an unfair multiplayer advantage, or cheat online;
  • disrupt a session, overload a network, evade a mute or removal, or interfere with a device or connection;
  • get unauthorised access to an account, system, build, service, or data;
  • support unlawful gambling, an illegal transaction, or another unlawful purpose; or
  • help another person to do an action in this list.

Player names, lobby names, character markings, portraits, and chat messages must follow these rules.

9. Moderation, reports, and enforcement

A session host can mute, remove, or refuse a player. Bitspire can investigate reported conduct. Bitspire can warn a user or restrict, suspend, or permanently remove access. This action can apply to a playtest, online function, Discord Integration, Site function, or all Services.

Bitspire can take this action when it reasonably needs to enforce these terms, protect users, comply with the law, or protect Tithe. Tithe currently uses peer-hosted sessions. Bitspire does not centrally store ordinary in-game text or voice chat. Thus, Bitspire might not be able to get session communications after an event.

If you report serious misconduct, provide information and evidence that you lawfully have. Do not put yourself in danger to collect evidence.

10. Discord Integration

If you enable the Discord Integration and Discord activity sharing, Tithe can show live game activity on your Discord profile. This information can include:

  • that you are playing Tithe;
  • your general game state or location;
  • the elapsed session time;
  • the party size;
  • whether the party is joinable; and
  • invitation or join information.

Use Discord settings to control Discord activity sharing. Tithe can also give you controls for some functions. If you disable activity sharing, Rich Presence, invitations, or join functions might not work. You can still play offline.

Do not use the Discord Integration to send spam, deceive users, collect Discord data, avoid Discord controls, or break Discord rules.

Discord is a separate company. Bitspire does not operate Discord. Bitspire cannot promise that Discord will be available or take a specific action.

11. Private, test, and pre-release builds

A test or pre-release build can be incomplete or unstable. It can contain errors, operate differently from the release version, damage or reset save data, or never become a commercial product. Features, content, progress, compatibility, and system requirements can change without notice.

Do not share private material outside the approved test group unless Bitspire gives written permission. Private material includes private builds, non-public images or recordings, private documents, access links, and information marked as confidential. If Bitspire removes your access or tells you to delete a private build, stop using it and delete it promptly.

You can choose to give feedback. If you give an idea, suggestion, or bug report, you give Bitspire a perpetual, worldwide, transferable, sublicensable, royalty-free licence to use it. Bitspire can modify, commercialise, and include the feedback without payment or attribution. This licence does not transfer your ownership of a separate creative work that you clearly identify as Player Content.

12. Saves, screenshots, and local data

Tithe stores saves, character settings, game settings, achievements, and a persistent multiplayer identifier on your device. Tithe also stores screenshots that you request on your device. Make backups when you need them.

An update, test build, device fault, damaged file, cheat, or file deletion can change or erase local data. Bitspire does not promise that a save will work with every build. Bitspire will try to prevent unnecessary loss of progress when this is reasonably practical. Bitspire cannot guarantee this during testing.

13. Purchases, distribution, and refunds

Steam or another authorised distributor can handle a purchase or download. The distributor’s terms and policies apply to prices, taxes, billing, chargebacks, refunds, and payment data. Mandatory consumer rights also apply.

Tithe can include cosmetic items that achievements unlock. Unless a future function says otherwise, virtual cosmetics, achievements, game currency, and other in-game items have no real-money value. You cannot transfer them. They do not give you ownership rights outside your licence to use the Game.

14. Updates, changes, and availability

Bitspire can patch, update, balance, add, remove, suspend, or stop a Service. Bitspire can do this for development, security, legal, operational, or commercial reasons. An update can be necessary for online compatibility.

Bitspire will give reasonable notice of an important negative change when this is practical or the law requires it. These terms do not remove a mandatory right to a repair, replacement, refund, price reduction, cancellation, or other remedy.

A Service can be unavailable because of maintenance, a defect, an internet or platform outage, a host disconnection, a third-party change, or an event outside Bitspire’s reasonable control.

15. Ownership

Bitspire or its licensors own Tithe and Bitspire Studio content. This content includes logos, artwork, game systems, characters, audio, text, and code. Intellectual-property laws protect this content.

Third parties own their names and marks. Steam and Discord are examples. A reference to a third party does not mean that a partnership, sponsorship, or endorsement exists, unless we clearly say that it exists.

16. Third-party services and links

The Services can link to or work with third-party services. These can include Steam, Discord, Supabase, GitHub Pages, and Google Drive. Each provider controls its service. Its terms and privacy policy apply.

Bitspire is not responsible for third-party content, security, availability, or data practices, unless the law makes Bitspire responsible.

17. Disclaimers

These terms do not exclude a warranty or right that the law does not permit us to exclude.

To the maximum extent that the law permits, Bitspire provides the Services “as is” and “as available”. Bitspire does not promise that a Service will always be available, secure, continuous, free of errors, compatible with each device, or free of harmful components. Bitspire does not promise that it will correct each defect or recover each item of lost data.

Online contact with other players is unpredictable. Bitspire is not responsible for Player Content or player conduct only because it occurs in a peer-hosted Tithe session. Bitspire can take reasonable action after it receives a report.

18. Limitation of liability

These terms do not limit or exclude liability for:

  • death or personal injury that negligence causes;
  • fraud or fraudulent misrepresentation;
  • deliberate misconduct;
  • an obligation that the law does not permit us to limit; or
  • other liability that the law does not permit us to limit.

If you use the Services as a consumer, Bitspire is responsible for foreseeable loss or damage that results from its breach of these terms or its failure to use reasonable care and skill. Bitspire is not responsible for a loss that was not foreseeable. It is not responsible for a business loss that results from consumer use. It is not responsible for a loss that your breach, another player, a session host, a third-party platform, or an event outside its reasonable control causes, unless the law says otherwise.

If you use the Services for business, Bitspire excludes some liability to the maximum extent that the law permits. This exclusion applies to lost profit, revenue, business, goodwill, opportunity, expected savings, or data. It also applies to indirect or consequential loss.

Bitspire’s total liability for the Services will not exceed the amount that you paid directly for Tithe in the 12 months before the event that caused the claim, or £50 if no payment was made.

19. Termination

You can end these terms at any time. Stop using the Services and delete your copies of the Game. A platform process for accounts or cancellation can also apply.

Bitspire can end or restrict your licence or access if you materially or repeatedly break these terms. Bitspire can also act if you create a security or legal risk, misuse a private build, or if Bitspire stops the relevant Service.

When appropriate, Bitspire will give notice and a reasonable time to correct the breach. Bitspire can act immediately when it must protect users, systems, confidential builds, or legal rights.

Some sections continue after termination. These include ownership, feedback, disclaimers, limitation of liability, and governing law.

20. Changes to these terms

Bitspire can update these terms because Tithe, the Discord Integration, the law, platform requirements, or its business changes. Bitspire will publish the new terms and change the effective date.

If a change has an important effect on your rights, Bitspire will give more notice when this is reasonably practical or the law requires it. A change applies from its effective date. If you do not accept a change, stop using the affected Services.

21. Governing law and disputes

If you are a consumer, you keep mandatory legal protections in the country where you live. You can use any court that mandatory law makes available to you.

Subject to these consumer protections, these terms are governed by the laws of England and Wales.

Before you or Bitspire starts a formal case, make a reasonable effort to resolve the dispute. Contact the other party. Describe the issue and the resolution that you request.

22. General terms

If a court cannot enforce one part of these terms, the other parts continue to apply. The court will apply the affected part as much as the law permits.

If Bitspire does not enforce a term, Bitspire can enforce it later.

You cannot transfer your rights or duties under these terms without written permission from Bitspire. Bitspire can transfer these terms during a merger, reorganisation, sale of the Game or business, or operation of law. A transfer will not reduce mandatory consumer rights.

These terms, the Privacy Policy, and additional terms for a specific function form the complete agreement between you and Bitspire about the Services.
